Tariffs
At press time, there is still an ongoing trade dispute between the United States and China. While the federal government is still working towards
an agreement, the full details of said agreement have yet to be disclosed. The NCFA has been monitoring this issue throughout the past year, and as progress towards a finalized trade deal is made, we will provide updates to our membership in a timely fashion.
Waters of the United States
In October of 2019, the U.S. Environmental Protection Agency (EPA) and the Department of the Army repealed the Obama-era (2015) clean water rule, known as Waters of the U.S. or WOTUS. The repeal became effective on December 23, 2019.
As of January 2020, there are several challenges pending to the repeal of the 2015 WOTUS rule. Fourteen states, the District of Columbia and New York City challenged the Repeal Rule in December of 2019 in the Southern District of
New York. Due to the repeal, federal courts have slowly begun to suspend or dismiss the remaining challenges to the WOTUS rule itself. The final rule returns the regulations defining the scope of federal Clean Water Act jurisdiction to those portions of the Code of Federal Regulations (CFR) that existed before the amendments introduced in the 2015 WOTUS rule.
